
M2北极之旅条款
旅行组织方: (以下简称“组织方”)
参与者: (以下简称“参与者”)
为明确前往加拿大育空地区及西北地区旅行的权利义务,双方自愿达成以下协议:
A. 旅行概述
1. 旅行性质
本次旅行为前往加拿大育空地区(Yukon)及西北地区(Northwest Territories)的非常规旅行,主要内容包括探索极地地区、观赏极光等。旅行涉及寒冷气候、偏远地带及原始自然环境,居住条件可能较为简朴,餐饮条件可能与城市化标准不同。
2. 自愿参与
参与者在同意本协议前已充分了解旅行性质,并自愿参与本次旅行。若参与者对酒店或餐饮有城市化标准要求,例如连锁酒店或精致餐饮,请勿报名或同意本协议。
B. 行程安排
1. 行程计划
具体行程由组织方提供,参与者应提前阅读并确认。行程可能涉及极地探索、极光观赏等活动。
2. 不可抗力条款
因自然灾害、野生动物威胁、加拿大政府禁令、极地天气变化或其他不可抗力因素导致行程无法继续的,组织方保留更改行程、延期或取消行程的权利。
上述不可抗力因素包括但不限于暴风雪、冰面断裂、道路封闭、航班或交通中断、政府临时限制等。
具体调整方案由组织方根据实际情况决定,参与者无权要求原计划强制执行。
若因不可抗力取消旅行,已支付费用将在扣除不可退还的实际成本后退还。实际成本包括但不限于育空或西北地区的交通预订费、住宿预订费、许可费及其他已产生且不可退还的费用。
退款将在30个工作日内完成。
C. 住宿与餐饮
1. 住宿条件
受育空及西北地区资源限制,住宿可能为当地小型旅馆、木屋或其他当地住宿设施。
组织方将尽力安排合理住宿,具体住宿安排以实际预订房型为准。
住宿安排以行程便利、安全及接近较佳观景地点为主要考虑,例如极光观赏区域。参与者理解并接受当地住宿条件可能不同于城市化标准。
2. 餐饮安排
餐饮以适应当地旅行环境为原则,可能无法满足个性化需求。
参与者需自备路途饮食。组织方将组织采买准备,并给予必要的技术指导。
晚餐和早餐通常可由当地餐厅提供热餐,相关费用需由参与者自理,除非行程或订单中另有明确说明。
D. 费用与支付
1. 旅行费用
旅行费用包括:

向导费用;

其他行程中明确包含的费用。
旅行费用不包括:

往返机票;

个人消费;
-
签证费用;
-
旅行保险;

未在行程或订单中明确列明的其他费用。
2. 支付方式
参与者需在网站下单并支付全款。
3. 退款政策
参与者在出发前15天取消,扣除已产生费用(如预订费、线上支付手续费)后,可获得剩余金额的90%退款。
参与者在出发前7天内取消,不予退款。
因组织方原因取消旅行的,除不可抗力情形外,参与者可获得全额退款。
E. 责任与风险
1. 风险告知
本次旅行具有一定户外旅行风险,包括但不限于寒冷天气、偏远地区道路状况、天气变化导致的交通延误或行程调整等。
根据预计情况,本次旅行期间气温大约在0°C左右,但实际温度可能因地区、时间及天气变化而波动。
参与者需自行评估身体状况,并承担与自身身体状况、个人行为及旅行环境相关的相应风险。
2. 保险要求
参与者须自行购买涵盖加拿大北部医疗救援的旅行保险,并在出发前向组织方提供保险证明。
如参与者需要在加拿大境内购买相关保险,组织方可协助寻找保险公司,但不对保险产品内容、理赔结果或保险公司决定承担责任。
3. 责任划分
组织方对因自身过失导致的损失,应依法承担相应责任。
参与者因个人行为导致的后果,由参与者自行承担,组织方不承担责任。个人行为包括但不限于不遵守向导指示、擅自行动、擅自离队或从事危险活动等。
F. 育空及西北地区特别要求
1. 签证与入境
参与者需自行办理加拿大签证,例如ETA或旅游签证,并确保符合加拿大边境服务署(CBSA)的入境要求。
组织方可提供行程证明,但不负责签证申请,也不保证签证结果或入境结果。
2. 环保与法律
参与者须遵守育空及西北地区的环保法规,包括但不限于不遗留垃圾、不干扰野生动物、不破坏自然环境等。
参与者须尊重当地原住民社区,包括因纽特人或第一民族的文化习俗。违反相关法律、法规或当地规定的,参与者自行承担法律后果。
3. 紧急救援
育空及西北地区地广人稀,部分地区救援难度较高,救援成本可能较高。
参与者需确保其旅行保险覆盖医疗救援、紧急撤离及相关费用。
4. 装备要求
参与者需自备或租赁符合当地天气及旅行环境的装备,例如羽绒服、保暖鞋等。
具体装备清单由组织方根据行程情况提供。
G. 其他约定
1. 行为规范
参与者应遵守组织方及加拿大北部向导的安排。
参与者不得擅自离队,亦不得从事危险活动,例如未经许可擅自穿越冰面、进入危险区域或不听从安全提示等。
2. 争议解决
因本协议产生的争议,双方应先协商解决。
协商不成的,提交组织方所在地,或加拿大育空首府白马市(Whitehorse)有管辖权的法院或仲裁机构处理。
3. 协议确认与生效:
组织方已在产品页面明确提示:参与者完成下单即表示已阅读并同意《M2北极之旅条款》,相关条款自参与者下单时即对双方生效。
Travel Agreement
Travel Organizer: hereinafter referred to as the “Organizer”
Participant: hereinafter referred to as the “Participant”
To clarify the rights and obligations regarding the trip to the Yukon and Northwest Territories in Canada, both parties voluntarily agree to the following terms:
A. Travel Overview
1. Nature of the Trip
This is a non-conventional trip to the Yukon and Northwest Territories of Canada, focusing on polar-region exploration, aurora viewing, and related activities.
The trip involves cold climates, remote locations, and a pristine natural environment. Accommodations may be basic, and dining conditions may differ from urban standards.
2. Voluntary Participation
Before agreeing to this contract, the Participant fully understands the nature of the trip and voluntarily joins.
If the Participant requires urban-level hotel or dining standards, such as chain hotels or gourmet meals, they should not sign up for or agree to this contract.
B. Itinerary
1. Trip Plan
The itinerary is provided by the Organizer, and the Participant should review and confirm it in advance. Activities may include polar-region exploration and aurora viewing, etc.
2. Force Majeure Clause
If the trip cannot continue due to natural disasters, wildlife threats, Canadian government restrictions, polar weather changes, or other force majeure events, the Organizer reserves the right to modify, postpone, or cancel the itinerary.
Such force majeure events include but are not limited to blizzards, ice breakage, road closures, flight or transportation disruptions, temporary government restrictions, and similar circumstances beyond the Organizer’s reasonable control.
The specific adjustment plan shall be determined by the Organizer based on the actual situation, and the Participant cannot demand that the original plan be enforced.
If the trip is canceled due to force majeure, the payment will be refunded after deducting non-refundable actual costs. Such costs include but are not limited to transportation booking fees, accommodation booking fees, permits in the Yukon or Northwest Territories, and other incurred non-refundable expenses.
Refunds will be processed within 30 business days.
C. Accommodation and Dining
1. Accommodation Conditions
Due to resource limitations in the Yukon and Northwest Territories, accommodations may include small local lodges, cabins, or other local lodging facilities.
The Organizer will make reasonable efforts to arrange suitable accommodations, and specific accommodation arrangements will be subject to the actual room type reserved.
Accommodation arrangements are primarily based on itinerary convenience, safety, and access to favorable scenic locations, such as aurora viewing areas. The Participant understands and accepts that local accommodations may differ from urban hotel standards.
2. Dining Arrangements
Meals are arranged based on the local travel environment and may not meet personalized preferences.
Participants should prepare their own travel snacks. The Organizer will arrange purchases and provide necessary technical guidance.
Hot meals for breakfast and dinner are generally available at local restaurants, and the related costs shall be paid by the Participant, unless otherwise expressly stated in the itinerary or order.
D. Fees and Payment
1. Travel Costs
The travel costs include:

One large SUV for five people;

Accommodations;
-
Some meals;
-
Guide fees;
-
Other costs expressly included in the itinerary.
The travel costs do not include:
-
Round-trip airfare;
-
Personal expenses;
-
Visa fees;
-
Travel insurance;
-
Any other expenses not expressly listed in the itinerary or order.
2. Payment Method
The Participant must place an order and pay the full amount on the website.
3. Refund Policy
If the Participant cancels 15 days before departure, they will receive a 90% refund of the remaining amount after deducting incurred expenses, such as reservation fees and online payment processing fees.
If the Participant cancels within 7 days before departure, no refund will be issued.
If the trip is canceled due to reasons attributed to the Organizer, excluding force majeure, the Participant will receive a full refund.
E. Liability and Risks
1. Risk Acknowledgment
This trip involves certain outdoor travel risks, including but not limited to cold weather, remote road conditions, weather-related transportation delays, or itinerary adjustments.
Based on current expectations, temperatures during this trip are expected to be around 0°C, though actual temperatures may vary depending on location, time, and weather conditions.
The Participant must assess their own physical condition and bear the risks associated with their physical condition, personal actions, and the travel environment.
2. Insurance Requirement
The Participant must purchase travel insurance that covers medical rescue in northern Canada and provide proof before departure.
If the Participant needs to purchase insurance within Canada, the Organizer may assist in finding an insurance provider. However, the Organizer shall not be responsible for the content of the insurance product, claim results, or decisions made by the insurance company.
3. Liability Allocation
The Organizer shall bear corresponding legal responsibility for losses caused by its own negligence.
The Participant shall be responsible for consequences arising from personal actions, and the Organizer shall not be held liable. Such personal actions include but are not limited to ignoring guide instructions, acting independently, leaving the group without permission, or engaging in dangerous activities.
F. Special Requirements for the Yukon and Northwest Territories
1. Visa and Entry Requirements
The Participant must independently obtain a Canadian visa, such as an ETA or tourist visa, and ensure compliance with the requirements of the Canada Border Services Agency (CBSA).
The Organizer may provide travel documentation but does not handle visa applications and does not guarantee visa approval or entry into Canada.
2. Environmental and Legal Compliance
The Participant must follow environmental regulations in the Yukon and Northwest Territories, including but not limited to no littering, no disturbing wildlife, and no damaging the natural environment.
The Participant must respect Indigenous communities, including Inuit or First Nations cultural customs. Violators shall bear their own legal responsibility.
3. Emergency Rescue
Due to the vast and sparsely populated nature of the Yukon and Northwest Territories, rescue may be difficult in some areas, and rescue costs may be high.
The Participant must ensure that their travel insurance covers medical rescue, emergency evacuation, and related expenses.
4. Equipment Requirements
The Participant must bring or rent proper gear suitable for the local weather and travel environment, such as down jackets and insulated boots.
A detailed equipment list will be provided by the Organizer based on the itinerary.
G. Additional Agreements
1. Code of Conduct
The Participant must comply with the arrangements of the Organizer and northern Canadian guides.
The Participant must not leave the group without permission or engage in dangerous activities, such as crossing ice surfaces without authorization, entering dangerous areas, or ignoring safety instructions.
2. Dispute Resolution
Any disputes arising from this agreement shall first be resolved through negotiation.
If negotiation fails, the dispute shall be submitted to a court or arbitration body with jurisdiction in the Organizer’s location or in Whitehorse, Yukon.
3. Agreement Activation and Effectiveness:
The Organizer has clearly stated on the product page that by placing an order, the Participant is deemed to have read and agreed to the M2 Arctic Journey Terms. Such terms become effective and binding upon both parties at the time the Participant places the order.
